Recent research finds that the National Labor Relations Board (NLRB), the agency that governs most private-sector labor relations, overturned decisions representing over 4,500 years of precedent under the Obama administration. That is a big deal. Without the stability that comes from respecting precedent, it is extremely difficult for all parties to understand the rules of the game and conduct business. Just in the first few weeks of March, the D.C. Circuit Court of Appeals decided three cases that call out the NLRB for overturning precedent without any rationale for doing so, abusing its discretion in imposing orders, and bringing frivolous cases to the court.

Last November, the Federal Communications Commission issued new rules governing Internet service providers’ privacy practices. These rules followed a notice of proposed rulemaking issued by the FCC in early 2016. Last summer, CEI submitted joint comments with TechFreedom in response to this proposal, in which we explained how the FCC’s proposed rules exceeded the agency’s legal authority and were unwise as a policy matter.

Dianne Feinstein (D., Calif.) writes that the U.S. Department of Transportation’s decision to defer a $647 million federal grant for Caltrain electrification was “foolhardy” and that the modernization plan “deserves a fair review based solely on the merits of the project.” But Sen. Feinstein fails to question why federal taxpayers should be funding a San Francisco-to-Silicon Valley rail line that serves some of the wealthiest commuters in America.

Native Americans prepare to battle Trump over Utah national monument
In late 2016, then-President Obama designated a 1.35 million acre swath of forest and red-rock canyons in southeast Utah as the Bears Ears National Monument. According to a White House statement, the monument was established “to protect some of our country’s most important cultural treasures, including abundant rock art, archeological sites, and lands considered sacred by Native American tribes.” It was a victory for local tribes and conservationists, but some Utah residents are wary of what they see as government overreach and are encouraging their state officials call on the Trump administration to rescind the monument status.
