CNN Analyst Unaware Supreme Court Doesn’t ‘Change’ Laws
CNN Supreme Court analyst and author Joan Biskupic (pictured above) thinks Supreme Court justices go about “changing the law of land,” which, in fact, is what popularly elected lawmakers do. But under the U.S. Constitution, the Supreme Court doesn’t make the laws; it is supposed to interpret the laws Congress passes and review lower courts’ rulings based on current laws.
McConnell Says Dems Still Stoking Political Tensions After Kavanaugh
When a reporter asked him Wednesday how he’s trying to reduce partisan tensions in Congress, Senate Majority Leader Mitch McConnell (R-Ky.) blamed Democrats for the increased political bitterness generated during Justice Brett Kavanaugh’s confirmation. McConnell said Kavanaugh’s ill treatment by Senate Democrats is firing up Republican voters going into the November 6 midterm elections. But he also suspects both parties will see a very high turnout with all the political tensions.
MSNBC’s Mitchell Tries, Fails to Get Historian to Debunk Trump
When MSNBC anchor Andrea Mitchell (pictured above left) tried Wednesday to get historian Michael Beschloss to “fact-check” President Donald Trump’s claims on the Gettysburg Address as “fake news” on “Andrea Mitchell Reports,” he didn’t quite play along. Beschloss, author of the new book “Presidents at War,” replied, “Yes, [Lincoln] was criticized for the Gettysburg Address by newspapers that hated Lincoln and wanted to support his opponent the next year when he ran for re-election.”
Cuomo Insists Kavanaugh Didn’t Deserve ‘Presumption of Innocence’
CNN anchor Chris Cuomo insisted late Tuesday that “innocent until proven guilty” does not apply to Supreme Court Justice Brett Kavanaugh because the sexual assault allegations against him were considered in the Senate, not a courtroom. “But the presumption of innocence is a valued, valued construct in a court of law. We were not in a court of law. This was a kangaroo court. This was politicians fighting over a position on the Supreme Court,” Cuomo said on CNN’s “Cuomo Prime Time.”

First lady Melania Trump shared her thoughts on the #MeToo movement in a prime-time TV interview, echoing the comments of her husband, President Donald Trump — and echoing the stance of anyone who understands the importance of due process. The first lady suggested that “a high enough bar has not always been applied to judging accusations of sexual misconduct,” as Newsweek reported. “You need to have really hard evidence — that if you accuse [someone] of something, show the evidence,” she said in an interview with ABC’s “Good Morning America” that will air Friday and was teased on that show Wednesday.

Conservatives hope Supreme Court Justice Brett Kavanaugh will provide the deciding vote on a host of contentious legal issues — from affirmative action to abortion and religious freedom — where they often lost former Justice Anthony Kennedy, the fifth “swing vote.” While legal experts predict that Kavanaugh will have great influence in shaping the law in those and other areas, however, they contend it might take some time for his impact to be fully felt. The current term does not have many hot-button issues so far. “As it is, the term is kind of low-key for now,” said Ilya Shapiro, a senior fellow in constitutional studies at the libertarian Cato Institute.
